A state appeals court ruled that New York cannot implement tough anti-smoking regulations while a court battle over their legitimacy is going on. The regulations, touted as among the toughest in the nation, were to have taken effect Thursday. However, a five-judge panel of the Appellate Division of the state Supreme Court said that until the legal battle over the regulations is complete they should not be imposed. A state trial-level judge had ruled that the state Public Health Council lacked the legal authority to impose such regulations.
