The City of Costa Mesa, the Pacific Amphitheatre and the Orange County Fair on Tuesday reached an out-of-court agreement-in-concept to resolve their litigation on noise and other disputed matters. The draft proposal is being circulated for comment to citizens’ groups near the 18,765-capacity concert venue. The agreement, if approved by all three parties, would require Ned West--operators of Pacific Ampitheatre under a 40-year lease with the fair board--to abide by the city’s noise ordinances. Any Ned West violations of noise levels would be subject to fines and that money would go to sound-proofing measures for homeowners near the Pacific Ampitheatre. Ned West could be fined up to $9,000 a day under the draft agreement. The agreement would also prevent the city from underwriting any noise lawsuits filed against Ned West by citizen’s groups.
