LONG BEACH : D.A. Plans to Retry Officer Acquitted in Rape Case

The district attorney’s office plans to seek a new trial against a former Long Beach police sergeant who was recently acquitted of raping one woman and assaulting a second, authorities said Monday.
Robert Ballew, who was acquitted of rape and attempted rape, again faces charges of kidnap with intent to commit rape, the only charge a Pomona jury deadlocked on this month. In addition, Deputy Dist. Atty. Scott Carbaugh said he has added a second charge: false imprisonment.
John Barnett, Ballew’s attorney, said he will seek to have the charges dismissed. “Whatever the prosecutor may think, the evidence was insufficient to convict Mr. Ballew,” Barnett said, adding that the Pomona jury deadlocked 8 to 4 in favor of acquitting Ballew on the kidnap charge.
