Schools and Surplus

What’s wrong with this picture? Recent news stories had politicians debating what to do with the surplus money in the state budget. Now I read that the ACLU is suing the state concerning the bad condition some of our schools are in (May 18-19).
Can someone in the government explain in simple terms why we have this problem?
