FEC Appeals Finance Reform Ruling

WASHINGTON — The Federal Election Commission filed an appeal Tuesday challenging a federal judge’s ruling that invalidated 15 rules it had created to implement campaign finance reform legislation.
U.S. District Judge Colleen Kollar-Kotelly ruled Sept. 18 that the regulatory agency had misinterpreted the law when it devised the rules, creating an “immense loophole.”
She ordered the commission to rewrite the rules, though she did not set a timetable for doing so.
Most election experts do not think the judge’s ruling will have an effect on the November elections, but how the courts handle the FEC appeal will settle the question.
“We believe that the commission has a very strong case for appeal based on the factual circumstances as well as legal precedent,” FEC Chairman Bradley A. Smith said.
