L’enquête de #Disclose19 révèle ainsi que lorsqu’une personne refuse de donner son identité ou n’a pas de carte d’identité sur elle, des policiers sortent quasi instantanément leurs appareils NEO pour prendre en photo le visage de la personne, sans son consentement. Contrairement à ce qui est prévu par la procédure de vérification d’identité : • ils n’informent pas la personne qu’elle est « retenue sur place » (ce qui est une situation très rare, rappelons-le) pour une vérification d’identité ; • ils ne la présentent pas à un OPJ ; • les policiers utilisent l’appareil photo de façon immédiate et non pas en dernier recours ; • ils n’informent pas le procureur de la vérification d’identité ni de la prise de photographie ; • ils ne font pas de PV ni n’informent la personne de ses droits. Ces pratiques sont donc #totalement #illégales.
